Staff Roles and Responsibilities when Building Digital Image Collections

Outlined by JISC Digital Media services, the copyright discussion provides information on why copyright information is important to staff involved in building image collections and stages in the clearance of images for use in building digital image collections.  For the purposes of this guide to digitizing photographs I have outlined the specifics of this discussion below in accordance with the guide.

Things to consider before beginning a digitization project:
  • Determine that you own all the rights in the digital content that you are creating.
  • Determine that the content is out of copyright. However, it is important to remember that many digital images will include layers of rights issues.
  • Check that the agreements have been made with any funding bodies to ensure that there are no terms and conditions which might restrict your ability to make digital resources available.
  • Secured permission from all rights holders either directly or via licensing schemes.
Clearance of Images

1.      What do you want to use and how do you anticipate the image is going to be used?

2.      Understand the rights associated with the digital images.

3.      Identifying the rights holders.

4.      Clearing rights
·        Request permission.

5.      Managing digital rights
·        Who is responsible for copyright procedures or the rights licensed to you?
·        Be aware of your institution’s copyright procedures.
·        Metadata

6.      Protecting Digital Images
·        Credit lines
·        Access information

7.      Providing access to digital images
·        Access must follow the terms of the permission to use the images.

Photographs
It is important to note that photographs may be considered artistic or literary works that often have two copyrights.

1.      Copyright of the original object
2.      Copyright of the content within the photograph
